Official statement regarding the situation related to the construction of the “ORIGINAL LYUKS SERVIS” LLC facility

The Tashkent City Administration has received appeals from citizens who concluded contracts with “ORIGINAL LYUKS SERVIS” LLC for the purchase of apartments in the complex under construction at the address: 46a, Bishkent Street, Qo‘shqo‘rg‘on mahalla, Sergeli District.

On the instruction of the Mayor of Tashkent City, the available documents and the state of construction of the facility were studied regarding this issue, and an official inspection was conducted.

During the inspection, it was established that a land plot of 13,051 square meters was allocated to the developer on a lease basis in 2021. The construction permit was obtained in October 2022. The conclusion of the working body of the Architecture and Urban Planning Council was issued on 22 September 2023 under No. 97277837. The working project documentation was registered with the territorial construction control authorities on 29 July 2024 under No. 138348266.

The Tashkent City Administration is not a party to the contracts concluded between the citizens and the developer. Issues related to compliance with construction and apartment handover deadlines, refund of funds, compensation for possible damages, and the fulfillment of other obligations fall under civil-legal relations and are resolved in the manner established by law, including through the courts.

At the same time, the city administration understands the concerns of citizens who have invested in the purchase of housing. In making decisions on this issue, all appeals from the population, as well as reasonable demands and wishes, are of primary importance.

Taking into account the large number of citizens’ appeals and the social significance of the situation, a representative of the Tashkent City Administration held a meeting with the participation of housing buyers, the management of the construction organization, the prosecutor’s office, state construction control authorities, and representatives of other relevant agencies.

For information: according to the results of the study, construction works at the facility have been completed by approximately 53 percent.

During the meeting, citizens raised issues related to the completion of construction and the deadlines for handing over apartments, future sources of financing, the company’s credit and collateral obligations, as well as existing restrictions.

At the end of the meeting, the developer undertook to submit in the near future a clear schedule for resolving the issues raised by citizens and fulfilling the obligations assumed. The schedule includes the completion of construction stages, the formalization of necessary documents, and the handover of apartments. This schedule will be placed in a convenient location on the territory of the facility for citizens to familiarize themselves with.

This issue will be reviewed again at a meeting with the participation of housing buyers, the developer, the bank, law enforcement agencies, and relevant authorities. At the meeting, the schedule, information on sources of financing, and measures to fulfill obligations to citizens will be presented.

The situation is under the personal control of the Mayor of Tashkent City. Within its powers, the administration continues to facilitate mutual cooperation between citizens, the developer, the bank, and responsible agencies. The public will be informed about the further progress of the consideration of the issue.

We inform and remind that the presence of permitting and project documentation does not mean that the developer has fulfilled its contractual obligations to citizens. Therefore, before concluding a deal, one should be particularly careful: carefully study the terms and deadlines for fulfilling obligations, the financial condition of the developer, its business reputation, history of activity, and experience in implementing previous projects, as well as assess its ability to fulfill the obligations it has assumed.
